Bet the Company Litigation
Successfully defended medical device start-up in a bet-the-company lawsuit in the United States District Court for the Southern District of New York. Conducted extensive expedited document and deposition discovery and defeated request for preliminary injunction, leading to a favorable settlement for the client including termination of co-marketing, manufacturing and distribution agreement with the plaintiff.
Arbitration
Won $2+ million arbitration award for investors in a start-up involved in contentious disputes arising from start-up’s merger with a larger publicly traded company.
Real Estate Litigation
Successfully defended a commercial real estate owner against a purported buyer’s suit for specific performance of a purchase and sale agreement.
Product Liability Litigation
Successfully defended international flooring manufacturer in product liability actions.
Business Contracts Litigation
Brought suit on behalf of an international telecommunications carrier and froze over $650,000 of a defaulting customer’s assets at the outset of the lawsuit. Subsequently secured judgment for breach of contract and seizure of the funds for the client.
Successfully represented a pharmaceutical company in commercial/contract litigation with a clinical trial management company that it hired to manage the clinical trial of a new drug it had developed. Negotiated favorable settlement of the dispute at mediation.
Successfully defended a corporate client from claims of tortious interference with contractual relations brought by a competitor. Defeated the competitor’s motion for a preliminary injunction seeking to prevent the client from taking over accounts previously serviced by the competitor which led to a favorable settlement for the client.
