Notable successes in construction and design litigation include:
Successfully defended a highly regarded Boston area architect in a dispute with a client over the design and construction of a new high-end home. After document discovery and highly contentious depositions, obtained a favorable settlement of the dispute in mediation.
Won partial summary judgment on behalf of a building products manufacturer sued for negligence, breach of contract, and breach of warranty allegedly causing millions of dollars of property damage at a hotel due to water intrusion. Obtained a favorable settlement of all claims for the client following the summary judgment victory after threatening a follow-up summary judgment motion to eliminate the plaintiff’s remaining claims.
Successfully defended architectural and engineering firms and their joint venture from claims of negligent design and supervision arising from a motor vehicle-pedestrian accident at the site of a major public construction/renovation project. Secured a favorable settlement for the clients after extensive written and deposition discovery and filing a summary judgment motion.
